CRIMINAL CASES

Under New Jersey law, a statute of limitations to file charges from the government ranges from 1 year to  unlimited time depending on the crime.   See New Jersey Criminal Code 2C  at NJ CODE

For Criminal cases,  a prosecutor has one year to file charges for  petty offense misdemeanors (disorderly person) charges.   While other  misdemeanor charges must  be filed within 5 to 7 years.  

In regards to Felonies (indictable offenses)  Official misconduct and bribery allows  a prosecutor to file charges up to 7 years after the incident.  Other felonies have to be filed within 5 years or they can never be brought.    When children are under the age of 18 are victims of sexual assault, criminal sexual assault, and/or endangering the welfare of children, the state has 5 years after the victim turns 18 to prosecute the crime.  

There is not a statute of limitations for murder or manslaughter.  Technically, charges can be brought 60 years later from the crime.

Pagliara Law Group charges aa standard 1/3 contingency fee basis for its work on accident injury cases as well as medical malpractice and whistleblower cases.  This means we do not get paid unless we win your case.    At the clients discretion, we advance the costs of the litigation expenses for the case, which are reimbursed to the firm when your case settles, or after a successful trial and judgment.  A free consultation can be scheduled to discuss further. 

This does not apply to family law, criminal defense  or immigration cases.  Please discuss these fees with our office. 

You sure can.  It is a breeze to come to the other side that puts you first.  If you already have an attorney and are not happy.  You will meet with Attorney Nicholas Pagliara to go over your case and he will request your file from your past lawyer.  You never have to speak to the past lawyer again and they cannot reach out to you once you terminate their services.  We will take care of everything and get you back on the smooth road. 

Absolutely.  Your information is protected under the Attorney Client Privilege and work product.  Our office protects your confidentiality and we follow the model rules of professional responsibility of the New Jersey bar and all communication with us is kept absolutely confidential.

Generally, at least a year from the date of accident to settle if the injuries are obvious and there is no need to litigate the case in court.   On the other hand, if the injuries are severe and the insurance company will not pay the value of the injuries and  we need to file a lawsuit the timeframe will be increased to years for the case to settle or go to trial.   Having an experienced and relentless attorney that pushes forward and one that is aggressive is paramount.  We know how to negotiate and settle very quickly so you might be able to get paid in months and not years.
