Car accidents are a leading cause of death in the U.S.  More than 90 percent of all car crashes that occur in the U.S. each year are caused by human error.  This human error can come in many forms, like (but not limited to):

  • Driver errors, like distracted driving, drunk driving and reckless driving
  • Manufacturer negligence, such as vehicle design flaws or defective automotive equipment
  • Other negligence, like failures to maintain safe roadways.

When any form of negligence contributes to a car crash, victims (including families who lost a loved one to a deadly wreck) will likely have legal options for holding the negligent parties accountable.

Truck crashes are among the deadliest traffic wrecks. While the careless or reckless actions of truck drivers can cause these accidents, so too can the negligence of other motorists, trucking companies and other parties.

At Pagliara Law Group, P.A. we have vast experience advocating truck accident victims’ rights in various types of cases, including (but not limited to) claims involving:

  • Impaired truck drivers, like fatigued, drunk or distracted truckers
  • Rollover accidents
  • Jackknife accidents
  • Underride truck accidents
  • Municipal truck accidents.

Motorcyclists are among the most dangerous on the road and are vulnerable travelers on the roads. In fact, whenever traffic crashes involve a motorcycle rider, the rider is nearly 40 times more likely than people in passenger vehicles to be killed.

Sadly, most motorcycle accidents could be prevented if some party had been more attentive, sober and/or careful. Whenever negligence plays a role in causing a motorcycle accident, we can help you as the victims fight for justice and recovery.

10 percent of nursing home residents will be the target of some form abuse while staying in these facilities.  While nursing home abuse can involve physical assaults, threats, inaction and violence, it can also include emotional and financial abuse.

Regardless of whether this abuse comes at the hands of nursing home staff or others, the wrongdoers – and possibly the nursing home facility – can be liable for the harm they have caused.

Slips and Falls and Trip and Falls can happen anywhere, day to day, the places where you work, shop and go may not be as safe as they seem. This is particularly true when properties are not properly maintained and/or when risky areas of properties are not properly fixed.

When accidents at others’ properties cause injuries and harm, injured people can turn to the trusted and experienced attorneys at Pagliara Law Group, P.A  for answers about their legal options – and for extraordinary advocacy as we proceed with your case.

Our attorneys are experienced at representing injured people in all types of premises liability cases, and we know how to hold all negligent parties accountable for the harm they have caused our clients.

In the aftermath of a workplace accident or an occupational illness diagnosis, injured workers may be able to pursue:

  • A workers’ compensation claim – Although workers will not have to prove fault as part of these claims, they will have to follow specific rules, meet certain deadlines and possibly even see specific doctors (chosen by the employer or its insurance company).
  • A personal injury claim – This can be an option when the negligence of someone other than the employer, a co-worker or the injured worker contributed to the work injuries. These other parties can include equipment manufacturers, building owners, contractors and others.

At Pagliara Law Group, P.A., our lawyers can help injured workers and their families build and successfully resolve both workers compensation and related personal injury claims.

Losing a loved one is always difficult. When the loss could have been prevented if someone had been more careful, responsible or diligent, however, the impacts can be even more devastating, if not maddening.

At Pagliara Law Group, P.A., we are dedicated to helping families seek justice and financial recovery when any type of negligence has taken the life of their loved one(s). Though we are realize that compensation can never bring back a loved one, we also know that this compensation can be indispensable to helping families pick up the pieces and start rebuilding their lives.

That is why our attorneys handle various types of wrongful death cases, including (but not limited to) those involving:

  • Traffic accidents
  • Dangerous, faulty and toxic products
  • Work accidents.

6 VITAL & LITTLE-KNOWN FACTS ABOUT PERSONAL INJURY CASES

  1. The actions you do or don’t take after filing your case can impact its outcome – In other words, the events of the accident are NOT the only factors that can influence the strength and success of your claim. Actions or inactions like the following may also yield evidence that can affect whether your claim results in compensation and, in some cases, the amount of compensation obtained:
    • Actions like posting details of the accident to social media or providing recorded statements to insurers may detract from the strength of a plaintiff’s case. Conversely, actions like complying with all doctors’ orders and consulting a lawyer can help preserve the strength of a claim.
    • Inaction like failing to see a doctor or failing report an accident to an insurance company can also have negative impacts on a case. In contrast, a lack of action with regards to admitting fault or apologizing for an accident can be helpful to protecting a claim.
  2. A well-written demand letter may be sufficient to resolve a claim – Commonly sent before a lawsuit is officially filed, demand letters outline the details of a case and make some formal request for resolving the dispute. They can also explain that a lawsuit will be filed if the request is not met. When issues of negligence, liability and damages are fairly clear cut, a properly written demand letter can spark efficient, favorable resolutions to some personal injury cases.
  3. Most personal injury cases are resolved out of court – The vast majority of personal injury claims are not tried in a courtroom but are, instead, resolved outside the courtroom via negotiation, mediation, etc. This is often beneficial to both plaintiffs and defendants, as it can provide for faster resolutions and save litigation costs. At PAGLIARA LAW GROUP, P.A., we are always focused on achieving successful outcomes that meet our clients’ needs and goals. While that often means we strive to resolve cases outside of court, our experienced trial attorneys are always ready to try a case in court when that best serves our clients and their claims.
  4.  A jury verdict may NOT be the end of a claim – When a case ends with a verdict in favor of the plaintiff, the defendant may file an appeal, prolonging a case. When that happens, there is a risk that an appellate court may overturn the lower court’s verdict. Additionally, even if no appeal is filed, there can be challenges in getting the awarded compensation (like when a defendant may be insolvent or may flat-out disregard the judgment). As a result, this fact underscores the importance of having an experienced attorney in your corner for all phases of a personal injury case, including through a jury verdict and the payment of compensation.
  5. Medical liens may be paid from an award before the victim receives it – When injured parties are unable to pay for medical bills associated with their accident and injuries, providers (like doctors and hospitals) may file medical liens against the pending claim and the potential recovery. If the liens are not resolved before compensation is awarded and received, those liens can be paid out of the settlement or award before the plaintiff receives it. In the event of extensive medical costs, that may leave little to nothing for the victorious plaintiff. Again, an experienced lawyer can take care of this aspect of a claim to help injured people retain as much of their recovery as possible.
  6. It can be wise to plan for how a personal injury award will be handled – Specifically, setting up a trust to hold the settlement or award from a claim can be a smart way to maintain eligibility for need-based government benefits (like Social Security Disability and Supplement Security Income). This is due to the fact that assets held by a trust will not be counted as income or assets of the plaintiff (or beneficiary).
  7.

ABOUT MIDDLESEX COUNTY

Middlesex County is located in the central part of New Jersey and is home to more than 859,000 people, making it the state’s third populous county. Middlesex County is considered NYC metro.

The name Middlesex County, which New Brunswick is a part of, first started popping up in the English language over a thousand years ago, and referred to southeast England, where one of the first Middlesex Counties was founded.  “Middlesex” referred to the land of the Middle Saxons, while Essex referred to the land of the East Saxons, Sussex referred to the land of the South Saxons and Wessex referred to the land of the West Saxons.   New Brunswick is the city there and Rutgers college is there as well.

The vast majority of workers in the region commute over half an hour to work each day on the New Jersey Turnpike, running the length of Middlesex County, making it one of the busiest highways in the nation.  With such a diverse and growing population, with so many people on the highways each morning and so many businesses and industries employing so many workers, accidents are a fact of life. Whether on the road or at work, one must always be aware of the possibility of an accident or injury. However, when misfortune strikes most are not prepared to deal with the results.

Sometimes Being a Defensive Driver Isn’t Enough.

In 2012 alone, Middlesex County recorded 29,113 auto accidents. Over 6000 of these resulted in an injury to one or more people in the vehicles involved, and 54 people died in those crashes. Driving always carries with it an element of risk, but in Middlesex County, the number of commuters driving from home to work and back again along the Turnpike, one of the busiest stretches of road in the country, the risk can seem a bit more serious.

A lot of things can go wrong while driving. You can be a perfectly safe driver and still find yourself in an auto accident – someone cutting you off, changing lanes without signaling, not checking their mirrors, not paying attention while you slow down in front of them. Your fellow drivers can be distracted, can make mistakes and cause a messy collision. If you are lucky, an accident may likely end in nothing more serious than a few dings, a damaged quarter panel or a broken light. If you are not so fortunate, you may find yourself or your loved ones hospitalized with severe, life-altering injuries.

When the very worst happens, you need to have someone you can trust to help you. Calling an auto collision lawyer gives you access to the tools and expertise you need to get the compensation you need.

Worker’s Compensation Can Only Do So Much

Work related injuries are all too common in day-to-day life. From simple cuts and abrasions, to slip and fall accidents, to crushing impact injuries, the workplace can be dangerous – especially in fields like construction or factory work, where large machines and heavy loads are everywhere. In 2012 alone 83 people died in accidents while at work. Many accidents in the workplace can be caused by the negligence of others – people in too great a hurry to pay perfect attention to protocol, or management too distracted to make certain everyone has proper safety equipment and training.

An on-the-job injury can leave you in the hospital or out of work for weeks. The Worker’s Compensation system exists to help you cope during such times, paying you a portion of your wages while you recover – but there are limits to how much money you get. The typical worker’s compensation payout per week is between $220 and $826, but no more than 70% of your wages – possibly enough to survive on, but hardly adequate to pay for any medical bills or treatment that you may require as a result of your injury.

If you were injured at work through no fault of your own, speaking with a personal injury attorney is a vital step in your recovery. The person who bears the blame for your accident also bears responsibility for covering your damages. Having a trustworthy, experienced personal injury law firm on your side will help you defend your rights and get the compensation you are owed.

Statute of Limitations for Accident Litigation

A severe accident can leave you reeling, physically, mentally and emotionally. Catastrophic damage to your property, your person, or your family can be hard to cope with and hard to make sense of. You may feel the need to get your bearings, to let the accident ‘sink in’ so that you can better come to grips with it.

It may be prudent to take a moment and let yourself settle after such an ordeal – but you should not wait too long. Many types of accidents, no matter how damaging, carry with them statutes of limitations – periods of time after which filing a claim is no longer a valid option. It is important to contact a personal injury attorney as soon as you can, so that you can discuss your case and better understand your rights. Waiting too long may put you at risk of losing the ability to seek compensation for your loss, forcing you to bear the entire burden of your accident even though you bore little or none of the blame.
