Today, Pagliara Law Group, P.A. filed a eighteen count lawsuit against the County of Hudson and Hudson County Sheriff’s Office for the wrongful arrest on a outstanding warrant due to a mistaken identity in DOCKET NO:  HUD-L-000723-26 in Hudson County New Jersey Superior Court Law Division. The complaint filed can be viewed by clicking here as it is public record on the docket.

Plaintiff’s Complaint alleges that Defendants violated his constitutional rights by falsely arresting and unlawfully detaining him based on a clear case of mistaken identity.

The lawsuit, filed by Pagliara Law Group, P.A. in February 2026 arises from an incident in which Plaintiff was lawfully operating his vehicle as a Lyft driver with a paying passenger present when he was stopped and wrongfully arrested by law enforcement. Despite these clear discrepancies with the middle names being different and despite Plaintiff immediately and repeatedly informing officers that the warrant was for another individual—officers failed to verify the identity through readily available means such as confirming middle initial, date of birth, SBI number, or photo identification.

Plaintiff had no outstanding warrants at the time of the stop. The arrest was the result of name-only matching, reckless failure to verify identity, and disregard of multiple red flags demonstrating mistaken identity.

Have you been arrested because police failed to verify who you actually are?

You have legal rights.

No one expects to be handcuffed and jailed for someone else’s warrant — especially when the identifying differences are obvious and verifiable. If you were wrongfully arrested due to mistaken identity, failure to confirm warrant information, or reckless database reliance, you may have a strong claim for damages under federal and state law.

Law enforcement must confirm identity before depriving someone of their freedom. When they fail to do so, the Constitution provides a remedy.

If this happened to you, speak with an attorney immediately.

At Pagliara Law Group, we fight to hold negligent businesses accountable and protect the rights of patrons across New Jersey.

Why Law Enforcement Must Confirm Identity Before Arrest

Police officers have a constitutional duty to ensure they are arresting the correct person before depriving someone of their liberty. Arresting an individual solely based on a shared first and last name — without verifying middle initial, date of birth, or other identifiers — violates clearly established Fourth Amendment protections.

When officers ignore red flags of mistaken identity and proceed anyway, they may be liable under federal and state civil rights laws. Law Enforcement always try to hide behind qualified immunity as an innocent mistake but we relentlessly dismantle the qualified immunity to show there was no probable cause.

Legal Claims Often Asserted in Wrongful Arrest / Mistaken Identity Cases

In cases like this, our attorneys may pursue multiple causes of action, including:

  • False Arrest and False Imprisonment – unlawful deprivation of liberty without probable cause
  • Violation of Civil Rights (42 U.S.C. § 1983) – arrest under color of law without constitutional justification
  • Negligence – failure to properly verify warrant information
  • Reckless Disregard / Gross Negligence – ignoring obvious discrepancies in identifying information
  • Supervisory Liability – failure to properly supervise, train, and implement warrant verification protocols

Damages Suffered

Victims of wrongful arrest may suffer:

  • Loss of income (Plaintiff missed work driving for Lyft)
  • Humiliation (arrested in front of a passenger)
  • Emotional distress
  • Loss of liberty
  • Reputational harm
  • Compensation in civil rights cases may include lost wages, emotional distress damages, and punitive damages when conduct reflects reckless indifference to constitutional rights.

Take Action: Protect Your Rights

No one expects to be handcuffed and jailed because police failed to check a middle initial on someone’s else outstanding warrant.

If you were arrested due to mistaken identity, database errors, or name-only warrant matching, you may have a strong legal claim.

At Pagliara Law Group, we:

  • Investigate arrest procedures and dispatch records
  • Obtain warrant documentation and identity verification logs
  • Pursue accountability against agencies and supervisors
  • Fight for full compensation for constitutional violations

Law enforcement must verify before they arrest. Freedom cannot depend on a database glitch.
